Closure order imposed on Wallasey flat due to anti-social behaviour
Wirral Council has taken action to tackle persistent and disruptive anti-social behaviour centred around one particular address in New Brighton.
Officers have successfully obtained a three-month Closure Order on a flat on Tollemache Street following longstanding reports of serious anti-social behaviour causing significant distress to local residents.
The Closure Order was obtained under Section 80 of the Anti-Social Behaviour, Crime and Policing Act 2014 and was granted by Wirral Magistrates Court on 17 September 2026. It prohibits access to the property, with limited exceptions, until 4pm on 16 December 2026.
The court was satisfied that the use of the premises had resulted in serious nuisance to members of the public and that disorderly, offensive, or criminal behaviour had occurred, or was likely to occur, if the order was not granted.
The application followed extensive investigations carried out by Wirral Council’s Anti-Social Behaviour Team and Prima Housing Group, together with evidence provided by local residents.
The evidence presented to the court detailed persistent nuisance associated with the address, including frequent visitors attending at all hours, noise disturbance, shouting, swearing, and behaviour causing alarm and distress to other residents living within the building and the local community.
The court heard that local residents had experienced significant disruption to their daily lives and wellbeing over a prolonged period.
Complaints included sleep deprivation, concerns about personal safety, intimidation by visitors, and an inability to peacefully enjoy their homes. Despite numerous interventions, warnings, support offers and tenancy enforcement measures, the problems continued.
A Closure Order is one of the strongest powers available to local authorities and can be used where premises are associated with serious nuisance, disorder, or criminality.
Breaching a Closure Order is a criminal offence and can result in imprisonment, a fine, or both.
This is a really good example of the council working in partnership with other agencies to take decisive and effective action against those whose behaviour impacts negatively on other people – and the wider community. We will always look to use the powers we have under the law to tackle anti-social behaviour and nuisance neighbours when issues are reported to us.
